These Terms and Conditions (T&Cs) govern the relationship between No Worries Mobility (ABN: 30 673 427 502 ), hereafter referred to as "we," "us," or "No Worries Mobility," and you, the "Customer" or "User," for the use of our website, the purchase or rental of mobility equipment, and the provision of services.
1.1 Definitions:

2.1 Quote and Acceptance: A Contract is formed once we issue a Quote to the Customer, and the Customer accepts it. For online purchases or rentals, the contract is formed when the Customer completes the checkout process.
2.2 Modification and Cancellation: Once a Quote is accepted, the order cannot be canceled or modified unless we provide written consent. Any changes may incur reasonable fees for materials, labor, or storage.
2.3 Rental Terms: If Equipment is rented under the Contract, the additional Rental Terms (Annexure 1) apply.
2.4 Rent-to-Buy: If Equipment is purchased through Rent-to-Buy, the additional Rent-to-Buy Terms (Annexure 2) apply.
3.1 Description: All Equipment descriptions provided on our website are intended as a general guide. We reserve the right to change specifications at any time.
3.2 NDIS Participants: Customers renting or purchasing Equipment as NDIS (National Disability Insurance Scheme) Participants must comply with the NDIS terms, including feedback, complaints, and incident reporting (as outlined in Annexure 3).
4.1 Pricing: The prices displayed on our website or in any Quote are in Australian dollars (AUD) and include GST unless otherwise noted.
4.2 Invoices: All invoices must be paid in full prior to delivery, unless the Customer has an approved credit account.
4.3 Late Payments: We reserve the right to charge interest on overdue amounts and to reclaim any Equipment that has not been paid for.
4.4 Credit Card Payments: If paying via credit card, the Customer agrees to the terms of the payment processor, and No Worries Mobility is not liable for any issues arising from the payment process.
5.1 Delivery: Delivery dates are estimates only, and No Worries Mobility will not be liable for delays.
5.2 Acceptance: Equipment is deemed accepted by the Customer once delivered unless the Customer reports any Defect within 48 hours.
5.3 Title and Risk: Title to the Equipment remains with No Worries Mobility during the rental period and transfers to the Customer only upon full payment under Rent-to-Buy agreements. The risk of damage passes to the Customer upon delivery.
6.1 Rental Terms: When renting Equipment, the Customer agrees that the Equipment remains the property of No Worries Mobility. The Customer must not sublet, transfer, or modify the Equipment without written consent (see Annexure 1).
6.2 Rent-to-Buy: In a Rent-to-Buy agreement, title transfers only after the Customer makes all required payments (see Annexure 2).
7.1 Express Warranty: No Worries Mobility provides a warranty for defects in materials or workmanship. Warranty periods are stated on the product page or in the Quote (see Annexure 3: Warranty Process).
7.2 Australian Consumer Law: The Customer is entitled to guarantees under the Australian Consumer Law (ACL). In the event of major product failures, the Customer may choose a repair, replacement, or refund.
7.3 Limitations of Liability: To the extent permitted by law, No Worries Mobility is not responsible for any indirect, incidental, or consequential damages, including loss of revenue, profit, or data.
8.1 Ownership: No Worries Mobility retains all Intellectual Property Rights related to the Equipment and Services.
8.2 Customer Use: Customers are granted a non-exclusive, royalty-free license to use the Equipment only for the purposes outlined in the Contract.
9.1 Returns Policy: Equipment may only be returned if defective or if covered under ACL guarantees. Change of mind returns are not accepted. Hygiene-related products cannot be returned unless proven defective (see Annexure 4).
10.1 Personal Information: No Worries Mobility collects personal information in accordance with our Privacy Policy. By using our website and services, the Customer consents to this collection and use of their data.
10.2 Data Protection: We take reasonable steps to protect personal data. For more details, please refer to our full Privacy Policy.
11.1 Complaints: Customers may submit feedback or complaints via our website or by contacting us directly.
11.2 Opt-Out: If you do not wish to receive marketing materials or surveys, you may opt-out at any time by contacting us.
This Contract is governed by the laws of [State], Australia. Any disputes will be handled in the courts of [State], Australia.
No Worries Mobility reserves the right to amend these T&Cs at any time. Any changes will be posted on our website, and continued use of the website or services constitutes acceptance of the updated terms.
